This contract of public offer (further the Contract) regulates the relations on provision of services for realization of ready digital goods between the administration of the Site it-marketplace.ru, represented by Individual entrepreneur Kuznetsov Danila Adolfovich, further referred to as 'Administration', on one side, and the user of the Internet, the author of digital goods, hereinafter referred to as 'Seller'.
1. Subject of the contract
Based on this agreement, the Administration grants the Seller the right to place, for a percentage of sales on the Site or on partner sites, information about their works in the form of advertisements for the purpose of their implementation.
2. Contract Terms
The Administration offers the Seller services for using the Site to place information about finished IT products (hereinafter referred to as works) for the purpose of their realization to other Users through the Site on the terms specified in this contract. All transactions between the Seller and the Buyers are made directly. The Administration is a participant, intermediary, and organizer of these transactions.
3. Rights and obligations of the parties
3.1 Rights and obligations of the Seller
3.1.1 The Seller undertakes to comply with the copyrights of third parties and to exhibit for sale only their own works or other works with the consent of their owners, without violating intellectual property rights, otherwise the Seller shall be liable in accordance with the current legislation of the Russian Federation.
3.1.2 The Seller undertakes to independently compensate for all losses and expenses associated with the emergence of claims and claims for the provided works.
3.1.3 The Seller has the right to use the services of the Site only by filling out a special form at the address: it-marketplace.ru/add-product or their own email address, password, and login.
3.1.4 The Seller has the right to independently decide to stop the process of selling their exhibited works, delete the account, etc.
3.1.5 The Seller is obliged to verify the information about their works, exhibited for sale, and in case of identifying inaccurate information, make the necessary corrections to the advertising description of their works by informing the administrator of the content change.
3.1.6 The information published in the announcement must be accurate and precise.
3.1.7 The information reflected in the announcement or publication must not contain obscene language and its derivatives, information in any way violating the rights and freedoms of other individuals, social groups, races, nationalities, etc., as well as information otherwise contradicting the current legislation of the Russian Federation.
3.1.8 Publications conflicting with the norms of public morality are not subject to placement.
3.1.9 The announcement must not contain links to other sites (unless related to the implementation of the specific product or is a mandatory condition for the publication of works of third parties), as well as advertising information related to other types of activities.
3.1.10 Works published in announcements must have a sufficiently high level of graphic design. Otherwise, works may be rejected for publication.
3.2 Rights and Obligations of the Administration
3.2.1 The Administration has the right to independently decide on the sale or removal from sale of the Seller's works in case of non-compliance with the terms and rules of placing works.
3.2.2 The Administration has the right to move, extend, and terminate the demonstration period of the Seller's works for technical reasons, whether dependent on the Administration or not.
3.2.3 The Administration has the right to block or delete the Seller's account in case of violation of the conditions of this agreement by the seller and other serious violations.
The following are considered serious violations:
calls for violence, racial, national, gender, religious discrimination;
publication of child pornography and erotica, images and videos with scenes of violence, as well as any materials that violate the rights of minors;
publication of information of an indecent defamatory nature or containing obscene language and its derivatives;
calls for terrorism and the overthrow of the existing government;

4. Order of provision of paid services. Payment for such services.
4.1 Sellers who have properly agreed to the terms of this Agreement are entitled to use the services provided by the Administration on a paid basis.
4.2 The following types of services are provided by the Administration on a paid basis:
Product promotion.
'Move to the top' - the ad takes the first place in the catalog.
Block 'Featured products': on the main page, on catalog pages in the general list, on the catalog page in the ad category.

4.3 Payment for priority placement of ads (paid services) on the Site is made in accordance with the current agreement by transferring funds to the Administration's settlement account. The details can be found on the page: https://it-marketplace/about
4.4 The paid service is activated manually immediately after the seller's funds are received.
4.5 Payment for the sale of the Seller's goods is made by transferring funds or by any available method, including online payment by bank card through the operator AO 'T-Bank' or Moscow Branch of Joint-Stock Commercial Bank 'Modulbank' (Moscow Branch of JSC KB 'Modulbank')
4.6 The Seller bears the expenses for transferring funds.
4.7 The funds spent on account replenishment are non-refundable and can only be used for paid Site services.
4.8 Within 24 hours of payment, the Seller may request a refund of the amount paid if the payment was made in error. Erroneous payments can be refunded to a bank card upon request (submitted no later than 24 hours after payment), to the address refund@it-marketplace.ru. The funds will be refunded to the bank card within 5 (five) calendar days from the date of such request. The refund amount will be equal to the payment amount. In all other cases, the funds spent on account replenishment are non-refundable.
4.9 For residents of Russia, payment by bank cards is made through Moscow Branch of Joint-Stock Commercial Bank 'Modulbank' (Moscow Branch of JSC KB 'Modulbank') or AO 'T-Bank', Ivanovo, Russia. Cards of payment systems MIR, VISA, and MasterCard are accepted for payment. Payment can also be made using MIR Pay and T-Pay services. The security of payment is ensured by modern methods of verification, encryption, and data transmission over closed communication channels. Card details are entered on a secure bank authorization page. To make a payment, you need to enter the card details: number, cardholder name, expiration date, and three-digit security code (CVV2/CVC2). 5. Responsibility of the Parties
5.1 The Administration is not responsible for the accuracy of the information provided by the Seller in the advertisement.
5.2 The Administration is not responsible in case the Seller violates the copyrights of third parties.
5.3 The Administration is not responsible for the information posted by the Seller on the Site in open access. The Seller independently assumes risks when posting such information, including the risk of the email address being exposed to spam distribution and various fraudsters.
5.4 In case of violation of the terms of this agreement or the legislation of the Russian Federation, the Seller is responsible in accordance with the legislation of the Russian Federation.
6. Term of the contract
The moment of conclusion of this Agreement is considered to be the moment of the first placement of the user's goods on the Site using the form at: it-marketplace.ru/add-product . The Agreement enters into force from the moment of conclusion and is valid until the Seller removes the goods from the Site.
7. Other Conditions
7.1 The Administration has the right to make changes and corrections to this public offer agreement without prior notice to the website's users.
7.2 The execution of the conditions of this agreement is governed by the legislation of the Russian Federation.
